IMPORTANT NOTICE REGARDING DISPUTE RESOLUTION

THIS AGREEMENT CONTAINS A BINDING ARBITRATION AGREEMENT, A CLASS ACTION WAIVER, AND A MASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS. EXCEPT AS EXPRESSLY PROVIDED HEREIN, DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS THROUGH FINAL AND BINDING ARBITRATION.

YOU HAVE THE RIGHT TO OPT OUT OF ARBITRATION AS DESCRIBED IN SECTION 24.

  1. ACCEPTANCE OF TERMS

These Terms and Conditions (“Terms”) are entered into by and between you and Modeza Supplements LLC, operating under the brand name Elvarim (“Company,” “we,” “our,” or “us”).

These Terms govern your access to and use of:

Any related websites, checkout funnels, landing pages, subdomains, mobile applications, and services;

Any purchases of products offered through the foregoing (collectively, the “Website”);

Any products or subscription services (“Products”).

By accessing or using the Website, creating an account, enrolling in a subscription, clicking “I agree,” or purchasing any Product, you:

Represent that you are at least eighteen (18) years old;

Represent that you have legal capacity to enter a binding agreement;

Agree to be bound by these Terms in their entirety.

If you do not agree, you must not access or use the Website.

Where presented, you will be required to take an affirmative action (such as checking an unchecked box or clicking a clearly labeled button) acknowledging your agreement to these Terms before completing certain transactions.

Your affirmative action constitutes legally binding electronic consent.

Continued use of the Website after changes become effective constitutes acceptance.

Subscriptions auto-renew unless cancelled 24 hours before billing.

By opting in, you consent to receive recurring messages. Reply STOP to opt out.

  1. USER CONTENT

You grant a perpetual license to use submitted content.

  1. DISCLAIMERS

All services provided “as is.”

  1. LIMITATION OF LIABILITY

Liability limited to amount paid or $100.

  1. INDEMNIFICATION

You agree to indemnify the Company.

  1. TIME LIMIT

Claims must be filed within 1 year.

  1. DISPUTE RESOLUTION; BINDING ARBITRATION

All disputes resolved via AAA arbitration under Consumer Rules.

Single arbitrator. Individual basis only.

No class actions.

No mass arbitration. Claims may be batched.

  1. JURY WAIVER

No jury trial.

  1. OPT-OUT

Opt out within 30 days via written notice.

  1. SEVERABILITY

Invalid parts do not affect remainder.

  1. GOVERNING LAW

Wyoming law applies.

  1. MISCELLANEOUS

Entire agreement.
